ORDER. Suchanek's Motion to Vacate Dismissal with Prejudice, ECF No. #4 , is GRANTED and the Clerk is directed to REOPEN his case. The Settlement Administrator is also directed to reopen Suchanek's MDL Centrality account. Suchanek is required to show cause why his case should not be dismissed on statute of limitations grounds. His response is limited to no more than 8,000 words. Suchanek must file his response with this Court by October 10, 2024. Suchanek is required to serve Defendants via MDL Centrality with his CMO 57 34 Certification. Suchanek must serve this certification by October 10, 2024. ORDER - As an initial matter and consistent with CMO 57, Suchanek is required to show cause why his case should not be dismissed on statute of limitations grounds. Suchanek must file his response within 14 days from the date of this Order. Within 30 days from the date of this Order, Suchanek must serve on Defense Counsel a signed affidavit providing the following information, (see order image). Suchanek's failure to strictly comply with this Order, and more generally the requirements of CMO 57, will result in dismissal of his case with prejudice.
