ORDER GRANTING THE FLORIDA DEPARTMENT OF CORRECTIONS' MOTION FOR SUMMARY JUDGMENT. FDOC's motion for summary judgment is GRANTED only as to Turner's retaliation claim (Count I). The clerk shall remand the state law claims asserted in Counts II, III, and IV of Turner's complaint to the state court from which this case was removed. The clerk shall enter judgment stating "As to Count I of Stephanie Russ Turner's complaint, judgment is entered in favor of the Florida Department of Corrections."
