ORDER ON MOTION TO DISMISS - The report and recommendation ECF No. 23 , is accepted in part. The motion to dismiss, ECF No. 15 is granted in part. Mr. Thompson's claims for actual and punitive damages are dismissed. Mr. Tho mpson's claims for nominal damages and injunctive relief remain pending.
