ORDER GRANTING #17 MOTION TO DISMISS AND MOTION TO STRIKE. Slocumb alleges two claims against GEICO, one for breach of his uninsured motorist policy, and one for first-party bad faith. GEICO has moved to dismiss the bad-faith count (Count IV) and has moved to strike the attorney-fee demand as to the uninsured motorist claim (Count III). Slocumb concedes as to this issue, ECF No. #20 at 3 n.1, so the motion to strike will be granted. GEICO's motion (ECF No. #17 ) is GRANTED. Count IV is DISMISSED without prejudice. The fee demand in Count III is STRICKEN. GEICO has already answered as to Count III. Defendants Jamie and Chad Allen must respond to the complaint within 14 days (11/18/2020.)
