Filing 4 ORDER VACATING 11/02/21 REPORT AND RECOMMENDATION and DIRECTING PETITIONER TO (1) PAY FILING FEE OR SUBMIT MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS AND (2) FILE AMENDED 2254 PETITION - The Report and Recommendation (ECF No. #3 ) entered November 2, 2021, is VACATED. The Clerk of Court shall forward to Petitioner an application for leave to proceed IFP. Petitioner shall have until January 7, 2022, to either file a completed IFP application or pay the $5.00 filing fee. The Clerk of Court shall forward four 2254 forms to Petitioner, writing "AMENDED" and the case number on the blank forms. On or before January 7, 2022, Petitioner shall file an amended habeas corpus petition using the 2254 forms provided and following the instructions in this order. He shall submit the amended 2254 petition along with two identical copies of the amended 2254 petition and any attachments, and keep a copy for his records.
