ORDER: Plaintiff's motion to proceed in forma pauperis, ECF No. #2 , remains DEFERRED, because it is unclear whether Plaintiff is in imminent danger of serious physical injury. The Clerk of Court shall provide Plaintiff with a civil rights complaint form for use by a prisoner. Plaintiff must complete a new civil rights complaint form, marking it as "second amended complaint" and "Case No. 4:21-cv-00463-WS-MAF." If Plaintiff seeks to proceed with this case, he shall have until 2/7/2022, to file the amended complaint, typed or clearly written, not exceeding 25 pages, and submitted on the Court form. If Plaintiff no longer seeks to proceed with this case, Plaintiff should file a notice of voluntary dismissal pursuant to Rule 41(a) by 2/7/2022.
