ORDER. The docket shall reflect there are two Defendants in this action: Ricky Dixon, Secretary of the Florida Department of Corrections, and JPay, LLC. The Clerk shall issue a summons for Defendant Ricky Dixon, indicating he has sixty (60) days in which to file a response to the complaint, and refer the summons to the United States Marshals Service [USMS], along with the two service copies of Plaintiff's complaint. The Clerk shall prepare and send the USMS three copies of this Order, one for each of the named Defendants, and one for the USMS The Clerk shall also prepare a request to waive service of the summons (the AO 398 form), two copies of the waiver of the service of summons form (the AO 399 form), and a prepaid means for Defendant JPay, LLC to return the waiver form, and provide those documents to the USMS. The Clerk of Court shall issue a summons upon request from the USMS. In accordance with 28 U.S.C. 636(c)(2), the Clerk shall forward to Plaintiff a form for consenting to trial by the magistrate judge, with the case number written on it. If Plaintiff wishes to consent, the form should be signed and forwarded to counsel for Defendants (after a notice of appearance is filed).
