ORDER OF DISMISSAL. I now adopt #17 the report and recommendation and incorporate it into this order. I do not, however, make any finding about maliciousness. The clerk will enter a judgment that says, "This case is dismissed without prejudice based on Plaintiff's failure to accurately disclose his litigation history, a failure that constitutes a violation of this court's rules." REPORT AND RECOMMENDATION - In light of the foregoing, it is respectfully RECOMMENDED that Plaintiff's amended complaint, ECF No. #8 , be DISMISSED for failure to prosecute and as malicious for failing to honestly disclose Plaintiff's prior litigation history, and that his motion for a temporary restraining order, ECF No. #2 , be DENIED.
