ORDER ON MOTIONS FOR SUMMARY JUDGMENT. Plaintiff's motion for summary judgment against Aspen (Doc. #51 ) is GRANTED, and Aspen's cross-motion for summary judgment (Doc. #47 ) is DENIED. The Court defers entry of judgment until the issue of Plaintiff's entitlement to attorney's fees is resolved because that issue may render the claims against ORM and USI moot. The parties shall brief the issue of Plaintiff's entitlement to attorney's fees on the following schedule: a. Aspen's initial brief shall be filed 28 days from the date of this Order; b. Briefs in opposition shall be filed 14 days after Aspen's brief is filed; and c. Aspen may file a reply brief 7 days after the last response in opposition is filed or due. The Court defers ruling on ORM's motion for summary judgment (Doc. #49 )as well as potentially granting summary judgment in favor of USI pursuant to Fed. R. Civ.
