The City's #7 motion to dismiss the amended complaint is GRANTED with respect to the federal claims, and DENIED without prejudice with respect to the state law claims. The federal claims (Counts I to V) are DISMISSED with prejudice. The state law claims (Counts VI to VIII) are REMANDED back to the Circuit Court for the Fourteenth Judicial Circuit in and for Bay County, Florida. The Clerk shall close the file in this Court.
