ORDER DISMISSING CASE. THIS CAUSE is before the Court on Plaintiff's #40 Notice of Settlement, filed February 10, 2015. Therein, the Plaintiff indicated that the Parties have reached a settlement and will be executing a confidential settlement agreement resolving all claims, after which they will file a stipulated motion to dismiss this action with prejudice. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice. Within fourteen (14) days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the Settlement Agreement if filed, and/or to retain jurisdiction over the Agreement, if filed. ORDER TO SHOW CAUSE. On September 11, 2014, the Court issued an Order Scheduling Mediation for February 2, 2015 #34 . Therein, the parties were to mediate the issues in this action on February 2, 2015. Further, the Court instructed the parties that this date "shall not be rescheduled without leave of Court" and that, within seven (7) days following the mediation conference, a mediation report was to be filed indicating whether all required parties were present and, inter alia, whether the case settled. To date, however, no such mediation report has been filed. Accordingly, it is ORDERED AND ADJUDGED that Plaintiff's counsel is provided until February 13, 2015 to have the mediator's report filed or to show cause why this case should not be dismissed for non-compliance with the Court's Orders.
