Filing 16 PAPERLESS ORDER granting, in part, #12 Motion for Extension of Time to File Response/Reply/Answer. The court grants plaintiff's motion to extend time ONLY to the extent that his reply, which shall not exceed ten (10) pages, is now due by August 30, 2019. The reply must be filed (i.e., received by the court and docketed) by August 30, 2019. Absent extraordinary circumstances, the case shall be deemed submitted as of that date. Signed by Magistrate Judge Lisette M. Reid on 8/1/2019. (js05) |
Filing 15 PAPERLESS ORDER denying #13 Motion for Discovery; denying #13 Motion for Leave to File ; denying #13 Motion to Appoint Counsel. Plaintiff has filed a document he titles "motion to conduct discovery/expand the record." DE#13. Plaintiff contends that the "March 28, 2014[] hearing transcript provided by the [state] has been altered and Petitioner needs to retrieve a copy of the original transcript." However, the court has reviewed the transcript, DE#10-1, and it does not appear to be altered. Petitioner also says that he needs a hearing transcript in a particular state case. However, petitioner has not identified the alleged hearing that supposedly took place in that case. Therefore, his motion is inadequate and, hence, is denied without prejudice. At best, it appears that the concerns raised in this motion should be addressed in any reply to the state's response. Signed by Magistrate Judge Lisette M. Reid on 8/1/2019. (js05) |
