Date Filed Document Text
December 3, 2019 Opinion or Order Filing 18 PAPERLESS ORDER granting in part and denying in part #17 AMS, Inc.'s Unopposed Motion for Extension of Time to File a Separate Response to the Plaintiff's Statement of Claim. While it is true that AMS, Inc.'s co-defendant, John E. Murray, has not yet been served, AMS, Inc. does not dispute that Mr. Murray is, in fact, its owner. Therefore, the Court finds no good cause to allow AMS, Inc. to file a separate response to the Plaintiff's Statement of Claim. That said, despite the fact that a summons was issued for Mr. Murray on October 15, 2019 [ECF No. 3], the Plaintiff has not yet filed proof of service with respect to Mr. Murray. As such, the Defendants shall file a joint response to the Plaintiff's Statement of Claim within three business days of the date upon which Mr. Murray is served. Thereafter, the parties shall comply with the rest of the Court's Order in Actions Brought Under the FLSA [ECF Nos. 4 & 14], including by contacting Magistrate Judge Patrick M. Hunt's chambers to schedule a settlement conference, which must be held within thirty (30) days of the submission of the Defendants' Joint Response. Signed by Judge Roy K. Altman on 12/3/2019. (jz00)
