PAPERLESS ORDER granting #15 Defendant Imperial Fund I LLC's Motion to Quash Service and Denying #17 Plaintiff's request for hearing. The undersigned finds that Plaintiff has not properly served the Defendant. Plaintiff shall effect proper service on Defendant pursuant to Federal Rule of Civil Procedure 4(h)(1) or any in other manner allowed by Federal Rules of Civil Procedure. To properly effect service, Plaintiff shall deliver a copy of the summons and the complaint to an officer, a managing or general agent, or any other agent authorized by appointment or by law to receive service of process. F.R.C.P. 4(h)(1)(b). Defendant's principal address and the location of its agent for service of process is: 1720 Harrison Street, 7th Floor, Hollywood, FL 33020. Alternatively, Plaintiff can request that Defendant Imperial Fund I LLC waive service by following the steps provided in Federal Rule of Civil Procedure 4(d)(1). The waiver request must: 1) be in writing and be addressed to an officer, a managing or general agent, or any other agent authorized by appointment or by law to receive service of process; name the court where the complaint was filed; 2) be accompanied by a copy of the complaint, 2 copies of the waiver form appended to Rule 4 and a prepaid means for returning the form; 3) inform Defendant of the consequences of waiving and not waiving service; 4) state the date when the request is sent; 5) give Defendant 30 days to return the waiver; and 6) be sent by first-class mail or other reliable means. F.R.C.P. (4)(d)(1)(A)-(G). Plaintiff shall either effect proper service or request for waiver of service on or before February 12, 2021. Signed by Magistrate Judge Patrick M. Hunt on 12/23/2020.
