PAPERLESS ORDER GRANTING #10 Plaintiff's Motion for Leave to Proceed Anonymously (the "Motion"). Federal Rule of Civil Procedure 10(a) requires that "every pleading" in federal court "must name all the parties." Fed. R. Civ. P. 10(a). Nonetheless, a party may proceed anonymously by showing that she "has a substantial privacy right [that] outweighs the customary and constitutionally-embedded presumption of openness in judicial proceedings." Plaintiff B v. Francis, 631 F.3d 1310, 1316 (11th Cir. 2011) (citation omitted). Here, the parties agree that Plaintiff's use of a pseudonym during pre-trial filings is appropriate, but disagree on whether Plaintiff should be required to disclose her identity in her R. 26 disclosures. See generally (ECF Nos. 10, 16, 19); see also, Fed. R. Civ. P. 26 (a)(1)(A)(i). Having reviewed the filings and being otherwise apprised in the matter, Plaintiff will be permitted to proceed anonymously during pre-trial filings and need not disclose her true identity in the R. 26 disclosures. Moreover, the parties must meet and confer to develop a Stipulated Protective Order setting forth the conditions for disclosure of Plaintiff's identity. If the parties are unable to agree on the terms of a Stipulated Protective Order by February 1, 2021, they may file a motion with the Court. Signed by Magistrate Judge Alicia O. Valle on 1/25/2021.
