ORDER DISMISSING PETITION FOR A WRIT OF HABEAS CORPUS AS UNTIMELY AND CLOSING CASE. Petitioner Alexander Leo Brown's Petition for a Writ of Habeas Corpus under 28 U.S.C. 2254 [DE #1 ] is DISMISSED AS TIME BARRED. No certificate of appealability shall issue, as Petitioner has not "made a substantial showing of the denial of a constitutional right." See 28 U.S.C. 2253(c)(2). Petitioner may, by November 4, 2021, file a motion showing why the Court's determination of untimeliness is incorrect. Petitioner must explain in his motion why his 2254 Petition is not time barred. The motion may not exceed the (10) pages in length. The Clerk of the Court is instructed to CLOSE THIS CASE. Any deadlines are TERMINATED, any hearings are CANCELED, and any motions are DENIED AS MOOT.Under Fed. R. Evid. 201(b), the Court takes judicial notice of the Broward County Docket and related filings in Case No. 10005094CF10A.
