Following settlements reached during the arbitration of Plaintiff's claims, the parties have moved for confirmation of the arbitration order approving the FLSA settlement. The parties request the Court allow them to "email to chambers" their EEOC settlement agreement in the event the Court finds it appropriate to review both settlement agreements to ensure the fairness of the parties' FLSA settlement. [ECF No. 12] at 4 n.1. Given the Court's obligation to scrutinize a settlement of FLSA claims to determine that it is a "fair and reasonable resolution of a bona fide dispute over FLSA provisions," the Court finds it appropriate to review the settlement agreements to determine if the arbitration order should be confirmed. See Lynns Food Stores, Inc. v. United States, 679 F.2d 1350, 1355 (11th Cir. 1982). Therefore, the stay entered on March 21, 2022 [ECF No. 8] is LIFTED and this case is hereby REOPENED. The Clerk of Court shall restore this case to the active litigation docket. On or before October 24, 2022, the parties shall file their FLSA settlement agreement on the public docket. Additionally, on or before October 24, 2022, the parties shall file an appropriate motion requesting to file their EEOC settlement agreement under seal. The Court will not allow submission of this agreement solely by email. The Court will defer ruling on the parties' Motion to Confirm the Arbitrator's Approval of the FLSA Settlement Agreement pending the Court's review of the agreement. Signed by Judge Rodolfo A.
