July 5, 2022 Opinion or Order Filing 10 PAPERLESS ORDER. THIS MATTER is before the Court on the Parties' Joint Motion #8 for Extension of Time to File the Joint Scheduling Report. On June 17, 2022, the Court entered the Order of Referral #3 , making the Parties' Joint Scheduling Report due on or before July 1, 2022. The Order of Referral states "[n]on-compliance with any provision of this Order, the Federal Rules of Civil Procedure, the Local Rules, or this Court's Practices and Procedures... may subject the offending party to sanctions, including dismissal of this case. It is the duty of all counsel to take all actions necessary to comply with this Order." (Emphasis original.)On July 1, 2022, the Parties' filed the Joint Motion #8 for Extension of Time. As such, the Joint Motion failed to comply with this Court's practices and procedures, which state that "[a]bsent an emergency, requests for extensions of time must be presented to the Court, by motion, no later than 48 hours prior to the deadline from which the Parties are seeking relief. Sanctions may be imposed for non-emergent requests made less than 48 hours prior to the deadline." The Joint Motion states that counsel for both Parties is, or will be, out of the country, which does not constitute "good cause" for the extension. Nevertheless, it is ORDERED AND ADJUDGED that the Joint Motion #8 is GRANTED IN PART AND DENIED IN PART. The Parties' Joint Scheduling Report is due on or before July 12, 2022 at 5:00 p.m. Non-compliance with a Court order may result in sanctions, including dismissal of this case.
