October 12, 2022 Opinion or Order Filing 4 PAPERLESS ORDER denying #3 Motion for Extension of Time without prejudice. The Petitioner asks that we construe his Section 2254 Petition for Writ of Habeas Corpus as timely because his correctional institution went into an "Institutional Lockdown" due to the adverse effects of Hurricane Ianthereby preventing him from filing his Petition in a timely manner. Motion at 1. We think this equitable-tolling argument is premature because it is unclear whether the Respondent will argue that the Petition is untimely. However, if the Respondent does claim that the Petition is untimely, the Petitioner will be allowed to file a Reply, in which he can reassert the same equitable-tolling argument he advances in this Motion.
