PAPERLESS ORDER denying without prejudice Defendants Compass Group USA and Morrison Management Specialists' Motion to Compel Arbitration, ECF No. #8 . On February 24, 2023, the Court issued an Order Requiring Combined Responses, ECF No. #7 , which instructed Defendants that once all Defendants are served, all Defendants shall submit a single combined response or separate answers. However, two Defendants filed a Motion to Compel Arbitration before Defendant Alexis Allen was served. Moreover, in their Motion to Compel Arbitration, Defendants state, "[i]ndividual Defendant Alexis Allen was a manager for Morrison. Although she has not been served, she would also be a 'Compass Defendant,' and all of the arguments herein requiring arbitration would apply equally to Plaintiff's claims against Ms. Allen." Mot. at 1, n.1. The Court will not consider a motion filed on behalf of a defendant who has not yet been served or made an appearance in the case. Accordingly, ECF No. #8 is DISMISSED without prejudice. Defendants may refile their Motion to Compel Arbitration once all Defendants have been served. See ECF No. #7 . Signed by Judge Rodolfo A.
