May 12, 2023 Opinion or Order Filing 23 PAPERLESS ORDER cancelling 21 Zoom Discovery Hearing set for 6/2/2023 at 1:30 PM in the Miami Division before Magistrate Judge Jonathan Goodman. Defendants noticed for hearing the following issues: (1) whether "discovery should be stayed while a ruling on #15 Defendants' Motion to Dismiss... is pending" and alternatively, (2) whether "discovery should be conducted in phases." [ECF No. #19 ]. "Defendants propose that pre-certification discovery should be conducted first before discovery on the general merits." Id. The issues in the #19 Notice fall outside the scope of the #8 Discovery Referral Order. If one or more of the parties wish for discovery to be stayed pending a ruling on the #15 Motion to Dismiss, then that party (or parties) should file a written motion asking for relief from the Court. Judge Scola will then either rule on the motion or issue an order referring the motion to the Undersigned.If, on the other hand, there remains a dispute about a distinct discovery issue (unrelated to the stay or sequence of discovery), then either party should promptly notify my Chambers so the matter can be set for a discovery hearing.
