PAPERLESS ORDER denying without prejudice [DE 13] Motion for Referral to Volunteer Attorney Program. The Motion is denied without prejudice to re-file at a later date. At this current date and time, Plaintiff is faced with Defendants' Motion to Dismiss for failure to state a claim [DE 11], which was filed on August 9, 2023. A response was therefore due on or before August 23, 2023 pursuant to Local Rule 7.1(c)(1). But to date, there has been no response by Plaintiff but for Plaintiff's Motion for referral to a volunteer attorney, filed after the deadline for the response to the Motion to Dismiss. Because Plaintiff chose to file this case, he must now prosecute it or seek other resolutions. The Court may reconsider a motion for referral to volunteer attorney, but not before Plaintiff's response to the Motion to Dismiss. That response shall be filed on or before September 8, 2023.
