The Amended Complaint at DE 10 is hereby STRICKEN for failure to comply with Federal Rule of Civil Procedure 15(a)(2) regarding amended pleadings. That Rule says "a party may amend its pleading only with the opposing party's written consent or the court's leave." Because Plaintiff seeks to amend more than 21 days after the service of Defendant's responsive motion, Plaintiff is prohibited from amending the pleading as a matter of course pursuant to Federal Rule of Civil Procedure 15(a)(1). Thus, to amend the pleading, Plaintiff must comply with Rule 15(a)(2). This Order is without prejudice for Plaintiff to re-file in compliance with the applicable rule if so chosen. SO ORDERED.
