September 11, 2023 Opinion or Order Filing 4 PAPERLESS ORDER GRANTING #3 Plaintiff's Motion to Proceed in District Court Without Prepaying Fees or Costs (the "Application"). Having reviewed the Application, which Plaintiff submits under penalty of perjury, the Complaint (ECF No. 1), and being otherwise advised in the matter, the undersigned finds that Plaintiff is unable to pay the filing fee and that the Complaint states a plausible cause of action. See 28 U.S.C. 1915(a)(1), (e)(2)(B). More specifically, Plaintiff asserts that he has $451 in average total monthly income, with $200 in gift from family/friends and $251 in food stamps. See (ECF No. 3 at 1-2). Plaintiff also asserts that he has $563 in average monthly expenses, and has no income to pay the filing fee. Id. at 4, 5. Plaintiff asserts that he stays with family who provides shelter and daily needs, but who are also on a limited budget and cannot assist Plaintiff further. Id. at 5. Accordingly, Plaintiff's Application is GRANTED. Further, based on Supplemental Rule 3 for Social Security Actions under 42 U.S. 405(g), electronic service will be completed by the Clerk of Court.
