February 11, 2024 Opinion or Order Filing 47 PAPERLESS ORDER: THIS MATTER comes before the Court upon Petitioner's Motion to Supplement Zoom Witnesses for Evidentiary Hearing #46 , filed on February 9, 2024. Petitioner states, in general terms, that the additional witnesses will be in Jamaica during the hearing "and are unable to travel to Florida for the hearing" #46 . Petitioner also states, again in general and vague terms, that "[t]ravel to the United States is made particularly difficult due to Visa entry requirements for Jamaican citizens" #46 . To permit adequate consideration of the Motion, Petitioner is advised as follows. On or before February 12, 2024, Petitioner shall file a Supplemental Memorandum, with affidavits or other evidence as necessary, providing specifics for the Zoom request as to each supplemental witness being requested to testify virtually. Simply stating that such witnesses "are unable to travel" to a hearing scheduled a month ago, and then alluding to unspecified Visa requirements, will not suffice to support a further expansion of Petitioner's requests to deviate from the open-court default rule in Rule 43 of the Federal Rules of Civil Procedure. Signed by Judge Aileen M. Cannon on 2/11/2024. (mdo)
