Filing 15 PAPERLESS ORDER TO SHOW CAUSE. The Court previously ordered Plaintiff to file its response to Defendant Freedom Auto Transport LLC's Motion to Dismiss by April 8, 2024. ECF No. 14 . Plaintiff has not done so. Accordingly, Plaintiff is hereby ORDERED to file a response to Defendant Freedom Auto Transport's Motion to Dismiss no later than Wednesday, April 17, 2024, or show cause in writing by the same date why the Motion to Dismiss should not be granted by default. Signed by Judge Jacqueline Becerra on 4/15/2024. (nsy) |
Filing 14 PAPERLESS ORDER. THIS CAUSE is before the Court on Plaintiff's Motion for Extension of Time to Respond to Motion to Dismiss. ECF No. #13 . The Motion was filed at 8:44 p.m. on the day that Plaintiff's response was due, and Plaintiff did not attempt to confer with Defendant until a few hours before it filed the Motion. Further, Plaintiff did not provide a reason for the requested extension other than a vague, generalized reference to its attorney's "case load, which includes matters pending in both federal and state court." Id. at 4. Plaintiff's conduct in waiting until the last possible minute to request an extension of time, and failing to set forth good cause and meaningfully confer as the Local Rules require, justifies denial of the Motion in its entirety. However, given that the requested extension concerns a dispositive motion, in this one instance, the Court will permit Plaintiff a brief extension of time. Accordingly, it is ORDERED AND ADJUDGED that Plaintiff's Motion for Extension of Time, ECF No. #13 , is GRANTED IN PART AND DENIED IN PART. Plaintiff shall file its response to Defendant Freedom Auto Transport LLC's Motion to Dismiss no later than Monday, April 8, 2024. Signed by Judge Jacqueline Becerra on 4/4/2024. (nsy) |
