December 3, 2025 Opinion or Order Filing 29 PAPERLESS ORDER DENYING Plaintiff's request for emergency consideration of #27 Demand for Order of Preliminary Injunction to Halt all "State of Florida" Court Proceedings in Case 25000388MM10A and Protect Constitutional Rights Under 28 U.S.C. 1651, 28 U.S.C. 2283 and 28 U.S.C. 1361 (the "Motion"). Local Rule 7.1(d) requires a movant seeking emergency relief to certify that a "true emergency" exists because meaningful relief could not be provided on "a critical, non-routine" issue within seven days. C.W. by & through F.W. v. NCL (Bahamas) Ltd., No. 19-CV-24441, 2020 WL 1492904, at *1 (S.D. Fla. Mar. 21, 2020). The Court has reviewed the Motion and finds that, although Plaintiff alleges emotional, mental and physical distress, see e.g., ECF Nos. #27 at 1, 8, [27-1] at 33-39 (various impact statements), the relief requested does not present a "true emergency." See VMR Prods., LLC v. Elec. Cigarettes Outlet, LLC, No. 12-23092-CV-GOODMAN, 2013 WL 5567320, at *1 (S.D. Fla. Oct. 3, 2013) (""Emergencies generally involve risks to the health and safety of individuals, situations where a person is about to be deported, scenarios involving the imminent destruction of property, circumstances under which a business is in real danger of immediate failure or significant financial collapse, or cases where someone is at risk of being denied an essential service."). Accordingly, the Motion will not be handled on an expedited timeline. Further, the Clerk of Court is directed to delete the word "Emergency" from ECF No. #27 . Signed by Magistrate Judge Alicia O. First, emergencies generally involve risks to the health and safety of individuals, situations where a person is about to be deported, scenarios involving the imminent destruction of property, circumstances under which a business is in real danger of immediate failure or significant financial collapse, or cases where someone is at risk of being denied an essential service." VMR Products, LLC v. Elec. Cigarettes Outlet, LLC, No. 12-CV-23092, 2013 WL 5567320, at *1 (S.D. Fla. Oct. 3, 2013). Plaintiff's Motion is not an emergency. Second, although pro se Plaintiff has failed to timely comply with #4 Order Regarding Magistrate Judge Jurisdiction and Option for Case Reassignment to District Judge, considering Plaintiff's pro se status, the undersigned finds that reassignment is appropriate. Accordingly, pursuant to Administrative Order 2025-11, the Clerk is directed to randomly reassign this case to a District Judge, keeping the undersigned Magistrate Judge assigned to the case to handle any matters referred by the District Judge.
