PAPERLESS ORDER denying without prejudice Motions for Referral to Volunteer Attorney Program (DE #4 , #13 , and #14 ). "Appointment of counsel in civil cases is a privilege 'justified only by exceptional circumstances,' not a constitutional right." Rodriguez v. Burnside, 38 F.4th 1324, 1335 (11th Cir. 2022) (citation omitted). Plaintiff does not contend that exceptional circumstances exist. While the Court nevertheless has discretion to make a referral to the volunteer attorney program, Plaintiff's motions fail to provide any compelling reason to show that referral to the volunteer attorney program would be appropriate at this time. Plaintiff may renew his motion for referral to the volunteer attorney program if and when Defendants file an answer to the complaint. In any renewed motion, Plaintiff should explain why the Court should make a referral to the volunteer attorney program. Signed by Magistrate Judge Jared M. Strauss on 9/29/2025. (emd)

Filing 12
PAPERLESS ORDER granting #11 MOTION for Leave to Proceed in forma pauperis; denying as moot #3 MOTION for Leave to Proceed in forma pauperis; denying as moot #7 MOTION for Reconsideration. The Court grants DE #11 as the Court finds that the motion sufficiently demonstrates that Plaintiff is unable to pay the costs for this proceeding. See 28 U.S.C. 1915. DE #3 is denied as moot in light of the filing of DE #11 . DE #7 is denied as moot in light of the filing of #10 Amended Complaint.By 8/29/2025, Plaintiff shall prepare and submit summonses to the Clerk for issuance to Defendants. Plaintiff may prepare the summonses using Form AO 440, which can be found at: https://www.uscourts.gov/forms-rules/forms/summons-a-civil-action. Additional information regarding the submission of summonses can be found in section 4D of the Court's Civil Filing Requirements, which is available on the Court's website and in the Clerk's office. As indicated therein, because Plaintiff has been granted leave to proceed in forma pauperis, he may motion the Court to order the United States Marshal Service to serve each defendant without cost to Plaintiff. However, regardless of whether the Court orders the Marshal to serve each defendant, it is Plaintiff's responsibility to prepare and submit summonses to the Clerk (by 8/29/2025) to issue to Defendants.
