PAPERLESS SUA SPONTE ORDER. On February 24, 2026, Plaintiff filed a document styled as a "Motion to Dismiss" [ECF No. 6], seeking to voluntarily dismiss this action without prejudice under Rule 41 of the Federal Rules of Civil Procedure. However, a Rule 12(b) motion is not the proper vehicle for a plaintiff to voluntarily dismiss his own case. If no defendant has served an answer or a motion for summary judgment, a voluntary dismissal must be effected through a notice of dismissal. See Fed. R. Civ. P. 41(a)(1).
