PAPERLESS ORDER Dismissing Action Without Prejudice and Closing Case. This action is dismissed without prejudice as this Court lacks subject matter jurisdiction. Plaintiff purports to assert that federal-question jurisdiction exists, but it is evident from the Complaint that this action does not arise "under the Constitution, laws, or treaties of the United States." 28 U.S.C. 1331. Even if this Court had subject matter jurisdiction, dismissal without prejudice would be appropriate because: (1) Plaintiff did not pay the filing fee, and a Clerk's note on the docket indicates that Plaintiff refused to file a motion to proceed in forma pauperis; (2) the Complaint clearly fails to state a claim upon which relief can be granted (and it is evident from the Complaint that amendment would be futile); and (3) this action is frivolous.
