June 26, 2026 Opinion or Order Filing 40 PAPERLESS ORDER denying #30 #36 #38 #39 Motions for lack of jurisdiction. Plaintiff has filed a notice of appeal in this case. ECF No. #22 . "Once a party files a notice of appeal, 'the district court is divested of jurisdiction to take any action with regard to the matter except in the aid of the appeal.'" Johnson v. CDC Gov, No. 21-21858-CIV-MARTINEZ, 2021 WL 3818307, at *1 (S.D. Fla. Aug. 12, 2021) (quoting U.S. v. Roemmele, 506 F. App'x 891, 892 (11th Cir. 2013)). This matter is now before the U.S. Court of Appeals for the Eleventh Circuit, and Plaintiff states that she has already been given electronic filing privileges pursuant to that appeal. ECF No. #39 at 2. Having reviewed Plaintiff's filings, the undersigned finds that, under these circumstances, there is nothing over which this Court would have jurisdiction while the matter is on appeal. June 16, 2026 Opinion or Order Filing 32 PAPERLESS ORDER denying #26 Motion to Reopen Case and Remove Court Officials; #27 Motion Denouncing Judicial Errors and Re-Submitting Filed Records. "As a general matter, the filing of a notice of appeal deprives the district court of jurisdiction over all issues involved in the appeal." Mahone v. Ray, 326 F.3d 1176, 1179 (11th Cir. 2003). However, a district court may act "in furtherance of the appeal," such that "district courts retain jurisdiction after the filing of a notice of appeal to entertain and deny a [Federal Rule of Civil Procedure] 60(b) motion." Id. at 1179-80 (citations omitted). The undersigned construes Plaintiff's motions as Rule 60(b) motions because they challenge previous court orders. "Rule 60(b) is an extraordinary remedy... which may be invoked only upon a showing of exceptional circumstances," and Plaintiff here has failed to establish any of the grounds (such as mistake, newly discovered evidence, or fraud) for granting the requested relief. Tucker v. Commonwealth Land Title Ins. Co., 800 F.2d 1054, 1056 (11th Cir. 1986) (cleaned up). Accordingly, the Motions are DENIED. Signed by Magistrate Judge Patrick M. Hunt on 6/16/2026. (klg)

The Court has reviewed the Motion and finds that Plaintiff has not presented a "true emergency." VMR Prods., LLC v. Elec. Cigarettes Outlet, LLC, No. 12-23092-CIV-GOODMAN, 2013 WL 5567320, at *1 (S.D. Fla. Oct. 3, 2013) ("Emergencies generally involve risks to the health and safety of individuals, situations where a person is about to be deported, scenarios involving the imminent destruction of property, circumstances under which a business is in real danger of immediate failure or significant financial collapse, or cases where someone is at risk of being denied an essential service."). Also, Plaintiff fails to conform with the requirements of Federal Rule of Civil Procedure 65(b)(1)(B), which requires a written certification describing his or her efforts to give notice to the adverse party and explaining why notice should not be required. "[T]he requirements of Rule 65(b)(1) are not mere technicalities but establish minimum due process." Woodard-CM, LLC v. Sunlord Leisure Products, Inc., No. 20-23104-CIV-WILLIAMS, 2020 WL 5547917, at *1 (S.D. Fla. July 29, 2020) (citation omitted). As an initial matter, Plaintiff fails to conform with the requirements of Federal Rule of Civil Procedure 65(b)(1)(B), which requires a written certification describing his or her efforts to give notice to the adverse party and explaining why notice should not be required.
