PAPERLESS ORDER denying #14 Motion for Reconsideration. Moving under Federal Rules of Civil Procedure 59(e) and 65(b), Plaintiff seeks reconsideration of this Court's order dismissing the Complaint. The undersigned has reviewed the Motion and the entire record. The Motion fails on its merits because Plaintiff fails to show "(1) an intervening change in controlling law; (2) the availability of new evidence; or (3) the need to correct manifest errors of law or fact." Guevara v. Padin, No. 16-23726-CIV-GAYLES, 2016 WL 10536989, at *1 (S.D. Fla. Nov. 30, 2016) (citing Douglas Asphalt Co. v. QORE, Inc., 657 F.3d 1146, 1151-52 (11th Cir. 2011)). Plaintiff also fails to show "grounds of mistake, fraud, inadvertence, misconduct, newly discovered evidence, or [that] the judgment is void." Asalde v. First Class Parking Sys., LLC, No. 16-20027-CIV-COOKE/TORRES, 2019 WL 5209076, at *1 (S.D. Fla. Feb. 26, 2019) (citing Fed. R. Civ. P. 60(b)). The Motion is DENIED. PAPERLESS ORDER denying emergency consideration of #1 Complaint. The Court has reviewed the filing and finds that Plaintiff is not entitled to emergency relief.First, although Plaintiff alleges that he is "in fear for his life due to an unlawful court date scheduled in Will County, Illinois, on August 31, where an attempt was made on his life," ECF No. #1 at 2, Plaintiff fails to plausibly show a reasonable basis for his fear. Second, it is unclear what relief Plaintiff is seeking and against whom (out of fifteen Defendants). To the extent that Plaintiff seeks a Temporary Restraining Order, Plaintiff fails to conform with Federal Rule of Civil Procedure 65(b)(1)(B), which requires a written certification describing "any efforts made to give notice [to Defendants] and the reasons why it should not be required." "[T]he requirements of Rule 65(b)(1) are not mere technicalities but establish minimum due process." Woodard-CM, LLC v. Sunlord Leisure Products, Inc., No. 20-23104-CIV-WILLIAMS, 2020 WL 5547917, at *1 (S.D. Fla. July 29, 2020). Also, an order for "immediate placement into housing" due to an allegedly "unlawful and unconstitutional forced eviction," ECF No. #1 at 9, is not warranted because "[f]ederal courts do not have subject matter jurisdiction over state eviction proceedings." PMG-Greybrook Riverfront I, LLC v. D'Amato, No. 23-60866-CIV-RUIZ, 2023 WL 3369721, at *1 (S.D. Fla. May 10, 2023).For these reasons, Plaintiff's request for emergency relief is DENIED.
