September 10, 2010 Opinion or Order Filing 28 TEXT ORDER granting 25 Defendant's Sworn and Unopposed Motion for Relief from Order Granting by Default Plaintiff's Motion To Compel Defendant to Produce Documents. On August 26, 2010, this Court granted by default Plaintiff's Motion to Compel due to Defendant's failure to timely respond to that Motion 23 . Defendant now seeks relief from that Order asserting that Defendant's failure to timely respond was due to an error in calculating the due date for the response to that Motion. Defendant states that the Plaintiff does not object to the Defendant's requested relief and further that, prior to the entry of the Court's Order, Plaintiff had agreed to a one-week extension of time for Defendant to respond to the Motion to Compel. Accordingly, the Court grants the Defendant's Motion for relief from the Order granting the Motion to Compel by default. The Defendant shall file a response to Plaintiff's Motion to Compel 21 on or before Friday, September 17, 2010. Signed by Magistrate Judge Andrea M. Simonton on 9/10/2010. (par)
