ORDER DISMISSING CASE WITHOUT PREJUDICE. This Cause is before the Court sua sponte. Plaintiff's Complaint 1 , filed on September 21, 2011, only sets forth conclusory allegations that Miami Beach police officers "harassed [Plaintiff] at his job and also provided false statements on official affidavit forms." Having reviewed Plaintiff's Complaint 1 and Motion to Proceed in Forma Pauperis 3 , it is ORDERED AND ADJUDGED that this action is DISMISSED WITHOUT PREJUDICE pursuant to 28 U.S.C. sec. 1915(e)(2)(B)(ii) for failure to state a claim upon which relief may be granted, Plaintiff's Motion is DENIED without prejudice, Plaintiff has until October 13, 2011, to file any amended complaint, and this case is CLOSED.
