February 10, 2016 Opinion or Order Filing 178 AMENDED ORDER DISMISSING CASE with prejudice. On January 13, 2016, the Court dismissed this case without prejudice as to Defendant MDT Personnel, LLC upon Plaintiffs' #168 Notice of Settlement. (See D.E. 169.) On January 21, 2016, the Court dismissed this action without prejudice upon the #172 Mediator's Report indicating that Plaintiffs had settled with the remaining Defendant, Labor Ready Southeast, Inc. (See D.E. 173.) In each Dismissal Order, the Court ordered the Parties to file the Settlement Agreement with the Court pursuant to Lynn's Food Stores, Inc. v. United States, 679 F.2d 1350, 1355 (11th Cir. 1982), "after which the Court may amend this Order to dismiss the above-captioned action with prejudice[.]" (See D.E. 169, 173.) On January 26, 2016, the Parties filed the Settlement Agreement with Labor Ready and a #174 Joint Motion for Approval of the Settlement Agreement. On January 26, 2016, the Court issued an Order requiring Plaintiff's counsel to submit an affidavit of fees and costs. (D.E. 175.) On January 28, 2016, the Parties filed the Settlement Agreement with MDT Personnel and a #176 Joint Motion for Approval of the Settlement Agreement. Each Joint Motion requests a dismissal with prejudice, and each Settlement Agreement contains a provision stipulating that the Court retain jurisdiction to enforce the terms of the settlement. On February 2, 2016, Plaintiff's counsel filed his #177 Affidavit of Attorneys' Fees and Costs.Having reviewed the Settlement Agreements pursuant to Lynn's Food, the Court finds that the agreements are a "fair and reasonable resolution of a bona fide dispute over FLSA provisions." 677 F.2d. at 1354. Accordingly, it is hereby ORDERED AND ADJUDGED that (1) the Settlement Agreements are APPROVED; (2) this case is DISMISSED WITH PREJUDICE as to each Defendant; (3) the Court retains jurisdiction of this cause solely for the purpose of enforcing the Parties' settlement agreements; and (4) this case remains CLOSED. No cell phone use permitted.Based on Defendant's motion, it appears as though counsel is under the mistaken belief that tomorrow's hearing concerns only the issue of a third party's non-appearance at a deposition, the subject listed in ECF No. 68. But there are other matters scheduled, as well. Specifically, Plaintiff's notice of hearing from December 18, 2015 [ECF No. #72 ] notes three additional broad categories of discovery disputes -- all concerning Defendant's purported failure to provide adequate responses to written discovery. No party has advised the Court that these three issues are no longer ripe, and the Court therefore believes that these issues will be discussed tomorrow. Indeed, the Court anticipates that these issues will take up the majority of the hearing time. Defense counsel must be prepared to discuss these issues. Although the Court usually tries to accommodate out-of-town counsel with requests to participate by phone in routine discovery hearings, the Undersigned is reluctant to do so if the hearing is anticipated to last more than an hour or if it involves detailed issues. One final point: The hearing was scheduled more than three weeks ago, yet defense counsel waited until the end of business (i.e., 4:56 p.m.) the night before the hearing to file the motion. What would counsel do if the Court were to deny the motion -- try to make last-minute flight arrangements or make a 10-hour round trip drive to Miami? December 22, 2014 Opinion or Order Filing 75 ORDER VACATING the Court's Order Consolidating Case No. 14-21496-CIV-Lenard ("Del Rosario Action") and 14-24234-CIV-Lenard ("Machado Action"), entered December 2, 2014 ("Consolidation Order," D.E. 56). On August 14, 2014, the Court entered an Order establishing, inter alia, a deadline of August 19, 2014 for joinder of Parties. (See D.E. #21 at 2.) On November 10, 2014, lead counsel for six of the seven Del Rosario plaintiffs separately filed the Machado Action, which is ostensibly an identical action bringing the same claims against the same Defendants. On December 1, 2014, the Court accepted Transfer of the Machado Action from Chief Judge Moore, and on December 2, 2014, the Court sua sponte entered the Consolidation Order. The Court finds that it entered the Consolidation Order in error. The Machado Action was filed as a separate (but virtually identical) action because the deadline to join parties had expired in the Del Rosario Action. Joining the actions would unfairly disadvantage the Defendants because it would force the Court to extend all of the deadlines, and would allow Plaintiffs to impermissibly circumvent the deadline for joinder of parties. Accordingly, it is ORDERED AND ADJUDGED that the Consolidation Order (D.E. 56), entered December 2, 2014, is VACATED. The Machado Action shall proceed separately and all further filings in that case shall be filed under case number 14-cv-24234-JAL. It is FURTHER ORDERED AND ADJUDGED that Defendants shall have until and including January 5, 2014 to file a response to the Machado Plaintiffs' Complaint. It is FURTHER ORDERED AND ADJUDGED that the Scheduling Order #21 entered in the Del Rosario Action is hereby AMENDED as follows: By December 5, 2014, all dispositive pretrial motions and memoranda of law must be filed, as well as any motions to exclude or limit proposed expert testimony.
