August 13, 2019 Opinion or Order Filing 259 PAPERLESS ORDER setting forth expedited deadlines for submission of deposition designations. On or before August 16, 2019, each party shall serve and file designations of any deposition transcripts they intend to use at trial. On or before August 22, 2019, an adverse party shall serve and file their counter-designations, together with any objections to a party's designations. On or before August 26, 2019, a party shall serve and file any rebuttal designations, together with any objections to an adverse party's counter-designations. On or before August 29, 2019, an adverse party shall serve and file any objections to a party's rebuttal designations. In accordance with the deadlines set forth above, the parties shall prepare and JOINTLY FILE one transcript for each deposition to be used during trial. The parties shall edit the transcript, using a mini-transcript when available, to remove all irrelevant, extraneous and unnecessary pages. Each portion of the testimony designated shall be bracketed to indicate beginning and end. A notice of filing setting forth each party's designated testimony by line and page, and setting forth all objections, shall be filed with the transcript. In addition to listing objections in the notice of filing, the objections shall also be indicated in the margin of the transcript. The parties may either write their objections in the margins, or use logical abbreviations that will be apparent to the Court and other parties (for example, "H" for hearsay). If the parties use abbreviations, the notice of filing must include a key or the Court's reference. A courtesy copy of the notice and transcript shall be delivered to chambers at the time of filing. Each party shall mark the courtesy copy of the transcript with a different color ink or highlighter to identify its designated portions of the transcript. All exhibits must be pre-marked. The Plaintiff's exhibits shall be marked numerically. Defendant's exhibits shall be marked alphabetically. If there are a large number of exhibits, the parties may file a motion to designate all exhibits numerically (e.g., Plaintiffs exhibits 1-99 and Defendants exhibits 100-200). "'The only grounds for granting [a Rule 59] motion are newly-discovered evidence or manifest errors of law or fact.'" Arthur v. King, 500 F.3d 1335, 1343 (11th Cir. 2007) (quoting In re Kellogg, 197 F.3d 1116, 1119 (11th Cir. 1999)). "'[A] Rule 59(e) motion [cannot be used] to relitigate old matters, raise argument or present evidence that could have been raised prior to the entry of judgment.'" Id. (quoting Michael Linet, Inc. v. Vill. of Wellington, Fla., 408 F.3d 757, 763 (11th Cir. 2005)). The Court finds that there is no basis for reconsidering the Court's Order Denying Defendant Joy Dorfman's Motion for Summary Judgment. (See D.E. #174 .) Defendant merely seeks to relitigate the same arguments she made in her Reply brief. (See D.E. #154 .) The Court has already rejected those arguments, and it made no manifest errors in doing so. On August 15, 2017, after the Parties had filed a notice of voluntary mediation, (D.E. #177 ), the Court entered an Order Scheduling Mediation with Judge Michael A. Genden for August 24, 2017 at 10:00 a.m. (D.E. #183 .) The thirty-two Plaintiffs were represented by: (1) one Plaintiff representative; (2) an attorney who is not counsel of record and who has power of attorney for all thirty-two Plaintiffs to negotiate and agree to the terms of any potential settlement; and (3) an attorney of record. The Court had permitted this practice at the Parties' prior mediation. (See D.E. #59 , 60.) However, on August 24, 2017 at approximately 11:00 a.m., Judge Genden called the Undersigned's chambers to report that Defendants refused to mediate unless all Plaintiffs were present. The Court spoke with the Parties telephonically and heard from all Parties who wished to be heard on the matter. August 14, 2017 Opinion or Order Filing 181 ORDER DENYING Third Party Defendants' Motion to Strike Pleadings and/or Dismiss as Discovery Sanctions for Failure to Comply with Discovery Requests. ("Motion," D.E. #166 .) First, the Motion fails to comply with Local Rule Rule 7.1(a)(3). That local rule requires that for every motion filed in a civil case (except for those specified by the rule), " counsel for the moving party shall certify either: (A) that counsel for the movant has conferred with all parties or non-parties who may be affected by the relief sought in the motion in a good faith effort to resolve the issues raised in the motion and has been unable to do so; or (B) that counsel for the movant has made reasonable efforts to confer with all parties or non-parties who may be affected by the relief sought in the motion, which efforts shall be identified with specificity in the statement (including the date, time, and manner of each effort), but has been unable to do so." Defendant's Motion does not contain the required certificate of conferral.Second, the Motion fails to comply with Federal Rule of Civil Procedure 11(c). Under that Rule, a motion for sanctions must be made separately and "must describe the specific conduct that allegedly violated Rule 11(b)." Fed. R. Civ. P. 11(c)(2). "The motion must then be served on opposing counsel, but may be filed with the court only if, within 21 days of the date of service, the challenged paper, claim, defense or denial is not withdrawn." Robinson v. Alutiq-Mele, LLC, 643 F. Supp. 2d 1342, 1350 (S.D. Fla. 2009) (citing Fed. R. Civ. P. 11(c)(2)). "Because of the penal nature of the Rule, the procedural requirements of Rule 11 are strictly construed." Id. (citing Miller v. RelationServe, Inc., No. 0561944CIV, 2006 WL 5849318, at *6 (S.D. Fla. Dec. 1, 2006)). "By its plain language, Rule 11 requires a movant to file and serve the same sanctions motion." Id. (citing In re KirkMurphy Holding, Inc., 313 B.R. 918, 921 (N.D. Fla.2004) (interpreting Bankruptcy Rule 9011, which is identical to Rule 11, as requiring that "sanctions are to be initiated by motion, and served upon the offending party 21 days prior to filing the same sanctions motion with the court.")). Here, Third Party Defendants failed to comply with Rule 11's procedural mechanism by serving Third Party Plaintiff with the motion for sanctions 21 days prior to filing it with the Court.Finally, the Court notes that although Third Party Defendants seek sanctions for alleged discovery violations, they never sought to have the discovery disputes resolved by Judge Goodman, as required by the Court's Beginning Order. (D.E. #26 .) Accordingly, #166 Third Party Defendants' Motion to Strike Pleadings and/or Dismiss as Discovery Sanctions for Failure to Comply with Discovery Requests is DENIED. November 14, 2016 Opinion or Order Filing 97 ORDER DENYING Defendants' #93 Motion for Extension of Time to Complete Discovery. On March 21, 2016, the Court entered an Order Setting Forth the Court's Policy on Motions for Extension or Stay of the Scheduling Order Deadlines. (D.E. #27 .) That Order provides:"Motions for extension of time or for stay regarding the deadlines set forth in the Court's Scheduling Order are highly disfavored. The parties select and agree to their deadlines as set forth in the Joint Scheduling Report. Thereafter, the Court enters its Scheduling Order and sets the trial date accordingly. Therefore, in order to preserve the trial date and the administration of the court's docket, the court will only grant these motions in the rarest of circumstances such as an interlocutory appeal."On May 5, 2016, the Court entered a Scheduling Order pursuant to Rule 16 of the Federal Rules of Civil Procedure. (D.E. #46 .) The Scheduling Order adopted the dates and deadlines chosen by the Parties in their Joint Scheduling Form, (D.E. #42 -1), including an October 3, 2016 deadline for Plaintiff to provide its Rule 26 expert disclosures. (See D.E. #46 .) The Scheduling Order provides that "[w]ithin the fourteen-day period after this deadline, Plaintiff(s) shall make the expert witness available for deposition by Defendant(s)." (See id. at 2.)On October 5, 2016, Defendants filed a Motion to Amend the Scheduling Order, seeking to extend all pretrial deadlines by an additional sixty days after the Court issued a ruling on Defendants' Motion to Dismiss. (D.E. #85 .) On October 11, 2016, the Court denied that Motion (with one narrow exception not relevant here): (1) stating that "[t]he Parties are permitted to choose their own deadlines, and they are expected honor them"; (2) stating that the Parties are "likewise expected to engage in discovery and otherwise litigate the case even while potentially dispositive motions are pending"; (3) citing the Court's March 21, 2016 Order Setting Forth the Court's Policy on Motions for Extension or Stay of the Scheduling Order Deadlines; and (4) finding that Defendant had not met the Rule 16(b)(4) "good cause" standard for modifying a Scheduling Order. (D.E. 88 (citing Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1418 (11th Cir. 1998).On October 27, 2016, Defendants filed the instant Motion for an Extension of Time to Permit the Deposition of Expert Witnesses, seeking a thirty-day extension to depose Plaintiff's proposed expert, Stephen Chamberlin. (D.E. #93 .) According to Defendants' Motion and Plaintiffs' Response, Plaintiffs disclosed Mr. Chamberlin on the October 3, 2016 expert disclosure deadline. Pursuant to the Court's Scheduling Order, Defendants had fourteen days thereafter--until October 17, 2016--to depose Mr. Chamberlin. Defense counsel did not contact Plaintiff's counsel to schedule Mr. Chamberlin's deposition until October 19 or 20. (Mot. at para. 15-16.) The only excuse Defendants offer for their failure to timely depose Mr. Chamberlin is Counsel for Defendants' status as a "sole practitioner" and the extensive work he was required to perform in other cases during that two-week period. (Id. at para. 22.) He also suggests that Plaintiffs' Counsel attempted to "hide the ball" when it came to Mr. Chamberlin's deposition, but this appears to refer to Plaintiffs' Counsel balking at Defendants' attempt to wait until after the deposition deadline to notice Mr. Chamberlin for a deposition.Federal Rule of Civil Procedure 16(b)(4) states: "A schedule may be modified only for good cause and with the judge's consent." "This good cause standard precludes modification unless the schedule cannot 'be met despite the diligence of the party seeking the extension.'" Sosa, 133 F.3d at 1418 (quoting Fed. R. Civ. P. 16 advisory committee note). The Court finds that Defendants have not established good cause for amending the Scheduling Order and extending the deadline for Defendants to depose Mr. Chamberlin. Defendants did not notice Mr. Chamberlin for a deposition during the fourteen-day window to do so, did not move the Court for an extension of the deposition deadline until ten days after the deposition deadline, and have not shown that they could not meet the deadline despite their diligence. Furthermore, the Court denied Defendants request to extend the pretrial deadlines a mere sixteen days before they filed the instant Motion, and specifically quoted the Court's March 21, 2016 Order #27 Setting Forth the Court's Policy on Motions for Extension or Stay of the Scheduling Order Deadlines. (See D.E. 88.) The Court finds that an attorney's status as a solo practitioner does not itself provide "good cause" for modifying the Scheduling Order, much less so where, as here, that attorney did not exhibit any diligence in meeting the at-issue deadline. Accordingly, it is ORDERED AND ADJUDGED that Defendants' #93 Motion for Extension of Time to Complete Discovery is DENIED. This entry constitutes the ENDORSED ORDER in its entirety. Therefore, it is appropriate to make some observations.First, my initial, concededly cursory, initial review of the discovery dispute background materials submitted by Plaintiffs this afternoon to my efile inbox demonstrates that the parties have myriad discovery issues and that the one-hour hearing is likely to be inadequate to address all of them, or even most of them. Therefore, Plaintiffs' counsel should prioritize the discovery disputes and raise first the most-important disputes. The disputes which cannot be addressed and resolved in one hour will need to be rescheduled for another hearing.Second, although the Undersigned is sympathetic to counsel's schedules and family vacations and legal work in other cases, I cannot indefinitely postpone discovery hearings or other hearings to accommodate the personal schedule of one attorney. In other words, I cannot permit one attorney to hijack the Court's schedule and prevent issues from getting timely resolved by virtue of scheduling conflicts. Counsel for both sides will need to make arrangements for coverage in this case if they attempt to avoid the Courts Friday discovery calendar hearings for weeks on end.Third, as noted in the written discovery procedures order [ECF No. 26, p. 10], the Undersigned follows Fed. R. Civ. Pro. 37(a)(5), which requires the Court to award expenses, including attorney's fees, to the party prevailing on a discovery dispute. The award does not require a finding of bad faith by the party losing the discovery dispute. In addition, the Rule authorizes an expense award against the party, counsel or both. Depending on who was involved in the unsuccessful discovery position, the fees award may well be against counsel, at least in part. I typically enter fees awards in connection with discovery disputes because none of the limited exceptions applies. Fee-shifting awards for losing discovery disputes without substantial justification have ranged from $50 to more than $500,000, and a significant portion have been against attorneys.Fourth, the written discovery procedures order prohibits vague, conclusory boilerplate objections. It also prohibits formulaic objections.Fifth, a party who does not arrange to have an adequately-prepared designee at a Rule 30(b)(6) deposition and who does not agree to a second deposition will most likely, in the absence of compelling circumstances, be required to appear at a second 30(b)(6) deposition and will also be responsbile for the fees and costs. On the other hand, if a party incorrectly argues that a 30(b)(6) designee was not properly prepared, then that party and perhaps its attorney will most likley be on the wrong end of a fees award.Finally, the parties are encouraged to continue to try to resolve their discovery disputes even though a discovery calendar hearing has been scheduled.
