ENDORSED ORDER DENYING WITHOUT PREJUDICE PLAINTIFFS MOTION FOR RECONSIDERATION. THIS CAUSE is before me on #17 Plaintiffs' Motion for Reconsideration/Rehearing and/or Relief from Order Dismissing and Closing Case for Lack of Prosecution. I have reviewed the Motion, the record, and the relevant legal authorities. "The applicable standard for a motion for reconsideration is that the moving party 'must demonstrate why the court should reconsider its prior decision and set forth facts or law of a strongly convincing nature to induce the court to reverse its prior decision.'" Instituto de Prevision Militar v. Lehman Bros., 485 F. Supp. 2d 1340, 1348 (S.D. Fla. 2007) (quoting Socialist Workers Party v. Leahy, 957 F.Supp. 1262, 1263 (S.D.Fla.1997) (internal citations omitted)). "Courts have distilled three major grounds justifying reconsideration: (1) an intervening change in controlling law; (2) the availability of new evidence; and (3) the need to correct clear error or manifest injustice." Id. (quoting Cover v. WalMart Stores, Inc., 148 F.R.D. 294, 295 (M.D.Fla.1993) (citations omitted)). I entered 16 Endorsed Order Dismissing Case as a result of Plaintiffs' failure to prosecute the case. While Plaintiffs' Counsel alleges the lack of prosecution was mere neglect on his part, Counsel does not give any facts to support his claim of neglect. Plaintiffs' Counsel may refile this motion with an explanation for his failure to prosecute so as to allow me to make a determination regarding whether any of the grounds for reconsideration have been met. Accordingly, it is hereby ORDERED and ADJUDGED that Plaintiffs' Motion for Reconsideration is DENIED without prejudice. Signed by Judge Marcia G. Cooke on 5/4/2017. (ase)
