Though the supporting record includes an affidavit of service, which is prima facie evidence of service, the Court will grant the respondent an opportunity to defend its jurisdictional position through further briefing. Accordingly a motion to quash the subpoena shall be filed within (7) days that is supported by sworn evidence of any persons with knowledge of the jurisdictional argument. Failure to support the motion with sworn evidence and legal authority may be grounds for denial of the motion.If the jurisdictional argument fails, the Court will proceed with enforcement of the subpoena and find that all objections, except attorney-client privilege, may be deemed waived. A final determination on that issue will be made after the jurisdictional challenge is adjudicated.For now, the Court's Order #8 setting forth the terms of compliance with the subpoena is STAYED.Additionally, the Notice of Hearing #10 filed by the respondent in connection with the motion for reconsideration is STRICKEN. Under this Court's Rules, a hearing on a motion can be set only be the Court upon proper request, and no matters may be unilaterally set for hearing by counsel.
