Filing 26 ENDORSED ORDER Granting in Part and Denying in Part #17 Motion for Extension of Time. The #17 Motion is GRANTED only with respect to Defendant Zubair Group, Inc., whose time to respond to the #1 Complaint is extended nunc pro tunc from April 4, 2019, to April 24, 2019. See ECF No. #23 (Defendant Zubair Group, Inc. served on March 14, 2019, with answer due on April 4, 2019).With respect to the remaining Movants, however, the #17 Motion appears to have been filed nearly two weeks after their responses to the Complaint were due. See ECF Nos. #10 , #11 , #12 , #13 (remaining Movants served on February 28, 2019, with answers due on March 21, 2019). Under the Federal Rules, in order to obtain an extension of time after a deadline has already elapsed, the movant must demonstrate "excusable neglect." Fed. R. Civ. P. 6(b)(1)(B). Here, Movants have not even acknowledged their apparent neglect in responding to the Complaint, much less demonstrated that such neglect was excusable. Accordingly, the #17 Motion for Extension of Time is DENIED with respect to Defendants SCS Supply Chain LLC, Saad Aziz, Maaz Aziz, and Abedallah Yaser Afify. Signed by Judge Marcia G. Cooke on 4/15/2019. (smz) |
