The respondent was previously given 45 days to file a response to this court's show cause order, more than called for under the local and federal rules. The respondent seeks an addition 60 days to file its response. The respondent has not shown good cause to warrant an additional 60-day extension of time. The court is not unmindful of the fact that the respondent has a busy calendar. However, the court finds that extending the time to file a response to on or before May 23, 2019 is more than sufficient. Therefore, to the extent the respondent seeks a 60-day extension, the motion is DENIED. The respondent shall ensure that its response with supporting appendix is filed on or before the May 23, 2019 deadline, and that it is in compliance with this court's show cause order. While a federal Court has power to grant bail pending determination of a habeas corpus petition; Gomez v. United States, 899 F.2d 1124 (11 Cir. 1990), In re Louie L. Wainwright, 518 F.2d 173 (5 Cir. 1975), a prisoner seeking such release must show either 1) that there is a likelihood of success on the merits of a substantial constitutional claim; or 2) that extraordinary and exceptional circumstances exist which make the grant of bail necessary to preserve the effectiveness of the habeas corpus relief sought.
