July 8, 2019 Opinion or Order Filing 16 PAPERLESS ORDER denying without prejudice #7 Defendant's Motion to Dismiss Plaintiff's Complaint or, Alternatively, Motion for Summary Judgment (the "Motion"). "[W]hen the jurisdictional basis of a claim is intertwined with the merits [of the claim], the district court should apply a Rule 56 summary judgment standard when ruling on a motion to dismiss which asserts a factual attack on subject matter jurisdiction." Odyssey Marine Exploration, Inc. v. Unidentified Shipwrecked Vessel, 657 F.3d 1159, 1169 (11th Cir. 2011) (internal citation omitted). Jurisdiction is "intertwined with the merits of [the claim] when a statute provided the basis for both the subject matter jurisdiction of the federal court and the plaintiff's substantive claim for relief." Id. at 1170. Whether the "employer" to the action meets the 15-employee threshold for bringing a claim under Title VII is an element of the claim and not a jurisdictional issue. Arbaugh v. Y&H Corp., 546 U.S. 500, 516 (2006). Accordingly, the proper standard of review on Defendant's Motion is Fed. R. Civ. P. 56. The Court finds that summary judgment is premature as the case is in its initial stages and no discovery has been conducted. Defendant may renew its motion for summary judgment when appropriate.
