June 17, 2019 Filing 17 STIPULATION of Dismissal Joint by Carnival Corporation (Tejera, Valentina)
June 17, 2019 Opinion or Order Filing 16 PAPERLESS AMENDED ORDER DISMISSING CASE with prejudice. On May 17, 2019, the Court dismissed this action without prejudice upon Plaintiff's Notice of Settlement. (See D.E. 14.) Therein, the Court provided the Parties thirty days to, inter alia, request that the Dismissal Order be amended to one with prejudice by filing a stipulation of dismissal with prejudice. On June 17, 2019, the Parties filed a #15 Joint Stipulation for Dismissal With Prejudice. Accordingly, it is hereby ORDERED AND ADJUDGED that this case is DISMISSED with prejudice, each party to bear its own attorneys' fees and costs. June 17, 2019 Filing 15 STIPULATION of Dismissal by Carnival Corporation (Tejera, Valentina)
May 17, 2019 Opinion or Order Filing 14 ORDER DISMISSING CASE. THIS CAUSE is before the Court on Plaintiff's #13 Notice of Settlement, filed May 16, 2019. Therein, Plaintiff indicates that the Parties have reached a settlement and anticipate filing dismissal papers requesting the Court to retain jurisdiction over the Parties' settlement agreement; however, the Parties have not filed the settlement agreement. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice, all pending motions are DENIED AS MOOT, and this case is now CLOSED. Within thirty days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement if filed. The Parties are advised that the Court does not retain jurisdiction over a settlement agreement without the Parties having filed the settlement agreement with the Court and, absent good cause, the Court does not review proposed settlement agreements for approval in camera. This entry constitutes the ENDORSED ORDER in its entirety. Signed by Judge Joan A. Lenard on 5/17/2019. (gie)
