September 10, 2019 Opinion or Order Filing 12 PAPERLESS ORDER granting in part and denying in part #10 Motion for Clarification; granting in part and denying in part #11 Motion for Extension of Time. Petitioner has previously been ordered to agree to the recharacterization of his motion as one brought pursuant to 28 U.S.C section 2254. He has filed a motion seeking clarification. It is unclear from this motion whether Petitioner objects to the reclassification. As will be recalled, by Petitioner's own admission, he previously filed a civil rights suit, assigned Case No. 16-23511-CV-Cooke, which was dismissed. By separate order, the court noted that Petitioner's filing, to the extent it could be construed as a habeas petition, needed to be opened as a separate case, and no further filing in the civil action case would be considered. See 16CV23511 91 . Petitioner was thus ordered to either agree to the petition's characterization as his first 2254 petition and file an amendment raising all issues on or before September 2, 2019, together with an application to proceed in forma pauperis. Petitioner has not done so.To the extent Petitioner seeks an extension of time to comply with this court's prior orders, the motion for extension is GRANTED. Petitioner shall file an application to proceed in forma pauperis and a notice with the court agreeing to the recharacterization of this habeas petition or seeking dismissal thereof on or before OCTOBER 10, 2019. If Petitioner agrees to the recharacterization, filing an amended petition on the proper form by the October 10, 2019 deadline.
