Date Filed Document Text
November 20, 2020 Opinion or Order Filing 7 PAPERLESS ORDER DISMISSING MOTION #6 AS SUCCESSIVE. The Movant has filed a purported motion to stay judgment. ECF No. 6. But, in the motion, he seeks to attack the Court's resolution of his claims on the merits and/or raise new substantive claims for relief. Therefore, the motion is properly construed as a successive 2255 motion. See Gonzalez v. Crosby, 545 U.S. 524, 532 (2005). Therefore, the Court must dismiss it for lack of jurisdiction. Burton v. Stewart, 549 U.S. 147, 157 (2007). The Court cautions the Movant not to file any further frivolous pleadings. If he continues to do so, the Court may order the Clerk not to accept any more filings from him in this case except any proper motion for leave to proceed in forma pauperis. The Clerk is directed to mail a copy of this order to the Movant at his address of record. Signed by Judge Robert N. Scola, Jr on 11/20/2020. (js05)
