October 13, 2021 Opinion or Order Filing 125 PAPERLESS ORDER. THIS CAUSE came before the Court upon the Parties' Joint Motion for Leave to Take Depositions After Discovery Deadline. #123 . Therein, the Parties "jointly request leave to depose certain individuals after the discovery deadline." Id. at 1. The deadline for the completion of discovery, including expert discovery, is October 22, 2021. See 79 . Now, Plaintiffs seek leave to depose Susan Dennis-Buss on October 28, 2021. #123 at 2. In addition, the Parties inform the Court that they disclosed their expert witnesses in accordance with the September 23, 2021 deadline to do so, and that they now intend to disclose rebuttal expert witnesses. Id. The Parties inform the Court that the deadline to disclose rebuttal witnesses under Fed. R. Civ. P. 26(a)(2)(D)(ii) coincides with the deadline to complete discovery on October 22, 2021. Id. The Parties thus seek leave to depose the respective rebuttal expert witnesses within fourteen (14) days of disclosure. Id. "District courts have 'unquestionable' authority to control their own dockets." Smith v. Psychiatric Sol., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (internal citation omitted). "This authority includes 'broad discretion in deciding how best to manage the cases before them.'" Id. (internal citation omitted). Once a scheduling order is entered, it "may be modified only for good cause and with the judge's consent." Fed. R. Civ. P. 16(b)(4). "To establish good cause, the party seeking the extension must establish that the schedule could not be met despite the party's diligence." Ashmore v. Sec'y, Dep't of Transp., 503 F. App'x 683, 685 (11th Cir. 2013); see also Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1419 (11th Cir. 1998). Here, given that the deadline to disclose rebuttal expert witnesses coincides with the deadline for discovery, the Court finds that there is good cause to extend the deadline for the Parties to depose the respective rebuttal expert witnesses. The Parties inform the Court that they "have conferred and agreed that this relief, if granted by the Court, will not impact any further deadlines set forth in the Court's Paperless Order Scheduling Trial (Doc. 18) and Paperless Order of Referral to Mediation (Doc. 19), as modified by the Court's Paperless Order Granting Defendant's Motion to Extend Discovery Deadlines and Continue Trial (Doc. 79)." The Court is skeptical, as the deadline to file pretrial motions, including motions for summary judgment, motions in limine, and Daubert motions, is November 12, 2021, see 79 ; that is, one week after the latest that a rebuttal expert witness could be deposed under the deadline the Parties have requested. The Parties shall therefore have ten (10) days to depose respective rebuttal expert witnesses after disclosure. Because the Parties inform the Court that Ms. Susan Dennis-Buss is not available to be deposed until October 28, 2021 because of "various commitments," #123 at 2, and the Court is extending the discovery deadline to permit depositions for rebuttal expert witnesses, Plaintiffs may depose Ms. Susan Dennis-Buss on October 28, 2021. September 7, 2021 Opinion or Order Filing 104 PAPERLESS ORDER TO SHOW CAUSE. THIS CAUSE came before the Court upon a sua sponte examination of the record. On December 1, 2020, Defendant filed a Notice of Removal, removing this action from the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida, to this Court. See #1 . On December 8, 2020, Defendant filed a Motion to Dismiss the Complaint. #12 . On January 11, 2021, after seeking an extension of time to respond to the then-pending Motion to Dismiss, Plaintiffs filed an Amended Complaint, presumably invoking their right to amend their pleading "once as a matter of course" under Rule 15(a) of the Federal Rules of Civil Procedure. June 15, 2021 Opinion or Order Filing 79 PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendant's Motion to Extend Discovery Deadlines and Continue Trial. ("Mot.") #71 . Therein, Defendant seeks a three (3) month continuance of trial and pretrial deadlines. See generally id. Plaintiffs filed a response in opposition. ("Resp.") #77 . Defendant filed a reply. ("Reply") #78 . The Motion is now ripe for review. "District courts have 'unquestionable' authority to control their own dockets." Smith v. Psychiatric Sol., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (internal citation omitted). "This authority includes 'broad discretion in deciding how best to manage the cases before them.'" Id. (internal citation omitted). Once a scheduling order is entered, it "may be modified only for good cause and with the judge's consent." Fed. R. Civ. P. 16(b)(4). "To establish good cause, the party seeking the extension must establish that the schedule could not be met despite the party's diligence." Ashmore v. Sec'y, Dep't of Transp., 503 F. App'x 683, 685 (11th Cir. 2013); see also Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1419 (11th Cir. 1998). Here, Defendant argues that a continuance is needed because Defendant has been diligent throughout the discovery period, however its attempts to understand Plaintiffs' case theory on their statutory claim has "been met with equivocation and delay"; Defendant has been prejudiced by Plaintiffs' refusal to make certain disclosures--specifically what Plaintiffs contend the usual and customary ("U&C") rates are--which has left Defendant to "conduct discovery in the dark"; as the case has evolved, so has the need to conduct additional discovery based on the underlying data in support of Plaintiffs' disputed claims; and the requested extension will not prejudice Plaintiffs as it comports with the trial schedule Plaintiffs initially requested. Mot. 10-16. In response, Plaintiffs argue that Defendant "knows exactly how Florida law defines the [U&C] provider charges" relevant in this context; where there are disputed discovery issues, "the parties have ample time to conduct discovery on those issues within the current schedule"--although Plaintiffs would be agreeable to a two-week extension of the expert discovery deadline; Plaintiffs "have produced voluminous discovery, including all relevant documentation regarding the patient accounts at issue and all relevant information necessary for Cigna to mount a defense in this case" and "[b]ecause both parties have produced the essential information, there is no reason to extend discovery for three additional months"; "nothing in the Second Amended Complaint necessitates any new fact discovery that was not already at issue from the outset of this case"; and Defendants have not and will not suffer prejudice, but rather extending trial "would clearly prejudice Plaintiffs, who seek to vindicate their statutory rights and recover payments that should have been remitted by Cigna over a year ago." Resp. at 3-10. In reply, Defendant argues that the brief extension sought will allow Defendant "to understand, investigate, and test Plaintiffs' conflicting theory of the Florida U&C [r]ate" and "allow the parties to resolve their outstanding discovery disputes and exchange relevant documents before depositions"; "Plaintiffs' response ignores that production of relevant information is only the first step" and "now Cigna and its expert must review and investigate those documents, which span hundreds of pages per patient"; and "Plaintiffs offer no reason whatsoever why they will be prejudiced or surprised" by the brief extension sought. Reply at 5-8. In consideration of all arguments raised and the procedural posture of this case, the Court finds that Defendant has shown good cause to grant a brief continuance in this matter. Accordingly, UPON CONSIDERATION of the Motion #71 , the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion #71 is GRANTED. This case is now set for trial commencing the two week trial period of January 31, 2022, at 9 a.m. in Courtroom 13-1, (thirteenth floor) United States Courthouse, 400 North Miami Avenue, Miami, Florida. All parties are directed to report to the calendar call on January 27, 2022, at 2 p.m., at which time all matters relating to the scheduled trial date may be brought to the attention of the Court. A final pretrial conference as provided for by Rule 16, Fed. R. Civ. P., and Rule 16.1(C), S.D. Fla. June 2, 2021 Opinion or Order Filing 68 PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiffs' Motion for Clarification or Partial Reconsideration. ("Mot.") #63 . Therein, "Plaintiffs seek limited clarification and/or reconsideration with respect to two specific pieces of information the Court has ordered Plaintiffs to include in connection with an amendment to Count I of their Amended Complaint." Id. at 1-2. "Reconsideration is an extraordinary remedy to be employed sparingly." Holland v. Florida, No. 06-20182-CIV-SEITZ, 2007 WL 9705926, at *1 (S.D. Fla. June 26, 2007) (citation and internal quotation marks omitted). "The only grounds for granting a motion for reconsideration 'are newly-discovered evidence or manifest errors of law or fact.'" United States v. Dean, No. 20-11603, 2020 WL 7655426, at *2 (11th Cir. Dec. 23, 2020) (quoting Arthur v. King, 500 F.3d 1335, 1343 (11th Cir. 2007) (per curiam)). A motion for reconsideration should raise new issues, not merely address issues litigated previously. Socialist Workers Party v. Leahy, 957 F. Supp. 1262, 1263 (S.D. Fla. 1997). "A party's disagreement with the court's decision, absent a showing of manifest error, is not sufficient to demonstrate entitlement to relief." Dean, 2020 WL 7655426, at *2 (citing Jacobs v. Tempur-Pedic Int'l, Inc., 626 F.3d 1327, 1344 (11th Cir. 2010)). On May 10, 2021, the Court dismissed without prejudice Plaintiffs' statutory claim against Cigna--which alleged that Cigna failed to reimburse Plaintiffs for services at the usual and customary ("U&C") rate--and granted Plaintiffs leave to file a second amended complaint with "an exhibit providing more claim-specific information identifying the treating Hospital, patient identification number, date of service, treatment provided, any applicable plan or policy providing coverage, payment received from Cigna, and alleged amount owed." ("Dismissal Order") #53 at 9. Now, "Plaintiffs request that the Court reconsider that portion of its holding [requiring Plaintiffs to] plead the 'alleged amount owed' on each claim and 'any applicable plan or policy providing coverage' [because] [t]hose two pieces of information are not reasonably accessible to Plaintiffs at the present time, nor are they necessary for Cigna to 'assess the validity of Plaintiffs' claims and whether each named Plaintiff has standing to sue and for which causes of action to formulate a responsive pleading.'" #63 at 3 (quoting Dismissal Order at 8). Plaintiffs argue that while they "are certain that Cigna underpaid their claims for services rendered in violation of the Florida statutory framework, they will not know the precise amount of the underpayment on each claim until [] expert analysis is completed." Id. at 5-6. As to the underlying insurance plan or policy, Plaintiffs argue that they do not obtain patient insurance information in all cases in the normal course of business as patients "may or may not provide their insurance cards." Id. at 7. In opposition, Defendant argues that "even after six months of discovery, Plaintiffs have refused to disclose what they contend is the methodology behind what they believe the Florida U&C [r]ate is, let alone the Florida U&C [r]ates themselves." Defendant argues that Plaintiffs' failure to disclose what they contend the U&C rates to be has deprived Cigna of the discovery it needs to probe Plaintiffs' theory of liability, jeopardizing the Court's scheduling order. Id. at 3-4. Defendant argues that insurance plan or policy information "must be within Plaintiffs' possession for Plaintiffs to submit claims to Cigna for reimbursement" and "there is no reason why Plaintiffs cannot include this information on their claims list now." Id. at 10. The Court does not find that Plaintiffs' have meet their heavy burden of showing manifest error warranting reconsideration here. Plaintiffs' "good-faith" belief that it has been underpaid by Cigna for services rendered is simply not enough to put Cigna on notice of how it allegedly violated the applicable statute requiring reimbursement at the U&C rate. Further, Plaintiffs must have some insurance-related information linking Cigna to the patients that Plaintiffs provided services to in order to state a valid claim against Cigna in each respective instance. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that Plaintiffs' Motion for Clarification or Partial Reconsideration #63 is DENIED. January 4, 2021 Opinion or Order Filing 19 PAPERLESS ORDER OF REFERRAL TO MEDIATION. Trial having been set in this matter for the two week trial period beginning October 25, 2021, at 9:00 a.m. pursuant to Rule 16 of the Federal Rule of Civil Procedure and Rule 16.2 of the Local Rules of the United States District Court for the Southern District of Florida, it is hereby ORDERED AND ADJUDGED as follows: 1. All parties are required to participate in mediation. The mediation shall be completed no later than eighty (80) days before the scheduled trial date. 2. Plaintiff's counsel, or another attorney agreed upon by all counsel of record and any unrepresented parties, shall be responsible for scheduling the mediation conference. The parties are encouraged to avail themselves of the services of any mediator on the List of Certified Mediators, maintained in the office of the Clerk of this Court, but may select any other mediator. The parties shall agree upon a mediator and file a Notice of Mediator Selection within fifteen (15) days from the date of this Order. If there is no agreement, lead counsel shall file a request for the Clerk of Court to appoint a mediator in writing within fifteen (15) days from the date of this Order, and the Clerk shall designate a mediator from the List of Certified Mediators. Designation shall be made on a blind rotation basis. 3. The parties shall agree upon a place, date, and time for mediation convenient to the mediator, counsel of record, and unrepresented parties and file a Notice of Scheduling Mediation no later than one hundred and ten (110) days prior to the scheduled trial date. If the parties cannot agree to a place, date, and time for the mediation, they may motion the Court for an order dictating the place, date, and time. 4. The physical presence of counsel and each party or representatives of each party with full authority to enter in a full and complete compromise and settlement is mandatory. If insurance is involved, an adjuster with authority up to the policy limits or the most recent demand, whichever is lower, shall attend. 5. All discussions, representations and statements made at the mediation conference shall be confidential and privileged. 6. At least ten (10) days prior to the mediation date, all parties shall present to the mediator a brief written summary of the case identifying issues to be resolved. Copies of those summaries shall be served on all other parties. 7. The Court may impose sanctions against parties and/or counsel who do not comply with the attendance or settlement authority requirements herein, or who otherwise violate the terms of this Order. The mediator shall report non-attendance and may recommend imposition of sanctions by the Court for non-attendance. 8. The mediator shall be compensated in accordance with the standing order of the Court entered pursuant to Rule 16.2.B.6, or on such basis as may be agreed to in writing by the parties and the mediator selected by the parties. The cost of mediation shall be shared equally by the parties unless otherwise ordered by the Court. All payments shall be remitted to the mediator within 30 days of the date of the bill. Notice to the mediator of cancellation or settlement prior to the scheduled mediation conference must be given at least two (2) full business days in advance. Failure to do so will result in imposition of a fee for one hour. 9. If a full or partial settlement is reached in this case, counsel shall promptly notify the Court of the settlement in accordance with Local Rule 16.2.F, by filing a notice of settlement signed by the counsel of record within ten (10) days of the mediation conference. This case is now set for trial commencing the two week trial period of October 25, 2021, at 9 a.m. in Courtroom 13-1, (thirteenth floor) United States Courthouse, 400 North Miami Avenue, Miami, Florida. All parties are directed to report to the calendar call on October 21, 2021, at 2 p.m., at which time all matters relating to the scheduled trial date may be brought to the attention of the Court. A final pretrial conference as provided for by Rule 16, Fed. R. Civ. P., and Rule 16.1(C), S.D. Fla. L.R., is scheduled for October 12, 2021, at 11 a.m. A bilateral pretrial stipulation and all other pretrial preparations shall be completed NO LATER THAN FIVE DAYS PRIOR TO THE PRETRIAL CONFERENCE. All motions to amend the pleadings or to join additional parties must be filed by the later of forty-five (45) days after the date of entry of this Order, or forty-five (45) days after the first responsive pleading by the last responding defendant. Any and all pretrial motions, including motions for summary judgment, Daubert motions, and motions in limine must be filed no later than eighty (80) days prior to the trial date. For a jury trial, counsel shall prepare and submit proposed jury instructions to the Court. The Parties shall submit their proposed jury instructions and verdict form jointly, although they do not need to agree on each proposed instruction. Where the parties do not agree on a proposed instruction, that instruction shall be set forth in bold type. Instructions proposed only by a plaintiff should be underlined. Instructions proposed only by a defendant should be italicized. Every instruction must be supported by citation to authority. The parties are hereby on notice that this Court requires all filings to be formatted in 12 point Times New Roman font and double spaced, including any footnotes, with one-inch margins on all sides. Failure to follow these formatting guidelines may result in the filing being stricken, any opposing filing being granted by default, and the imposition of other sanctions, including attorney's fees and costs.
