Date Filed Document Text
February 12, 2021 Filing 11 CLERK'S NOTICE re 10 Order. Order mailed per order. (pes)
February 11, 2021 Opinion or Order Filing 10 PAPERLESS ORDER: The Court denies #6 the Plaintiff's motion to reopen her case. When the Plaintiff initially filed her case, on December 23, 2020, the Clerk simultaneously noted on the docket that she had failed to submit either the appropriate filing fee or an application to proceed in forma pauperis. Five days later, the Court entered an order directing the Plaintiff to submit either the appropriate filing fee or an application to proceed in forma pauperis by January 11, 2021. When she failed to comply with Court's order, the Court dismissed her case, without prejudice, on January 13. The Plaintiff was, therefore, provided adequate notice and an opportunity to respond prior to the dismissal of her case. Furthermore, the dismissal was without prejudice. The Plaintiff has not set forth any basis, nearly a month after that dismissal, that would warrant the Court's reconsidering its order of dismissal. If the Plaintiff would like to pursue the relief requested in her complaint, she must initiate a new case. Because the Court denies the Plaintiff's motion to reopen, it denies #9 her motion to proceed in forma pauperis as moot. The Clerk is directed to mail a copy of this order to the Plaintiff at the address indicated on the docket. Signed by Judge Robert N. Scola, Jr. (kbe)

The Court directs the Clerk to close the matter. Any pending motions are denied as moot. Signed by Judge Robert N. Scola, Jr on 1/13/2021. See attached document for full details. (mc)

December 28, 2020 Opinion or Order Filing 3 PAPERLESS ORDER: Plaintiff Michelle E. Hudson Hale has filed a complaint, initiating this case, without including either the appropriate filing fee or an application to proceed in forma pauperis, contrary to the Court's Civil Filing Requirements Rule 4C. The Plaintiff is thus advised that, in order for her case to proceed, she must either submit the required fee or an application to proceed in forma pauperis on or before January 11, 2021. Should the Plaintiff fail to do either, the Court will dismiss her complaint without prejudice.
