PAPERLESS ORDER denying #11 Motion for Certificate of Appealability. Because he's brought a Section 1983 action, the Plaintiff doesn't need a certificate of appealability to pursue an appeal. See, e.g., Smith v. Catoe, 109 F. App'x 589, 589 (4th Cir. 2004) ("Because a certificate of appealability is not required to appeal from the district court's order denying relief in a 1983 action, we deny Smith's motion for a certificate of appealability as unnecessary."). PAPERLESS ORDER striking #3 Clerk's Notice of Filing Deficiency. The Plaintiff submitted a check of $400 in his efforts to initiate this new action. See Routing Slip [ECF No. 1-3]. But, of course, that would leave him $2 short of the full $402 filing fee for non-IFP plaintiffs. See United States District Court: Southern District of Florida, Fee Schedule, available at: https://www.flsd.uscourts.gov/court-fees (last accessed June 23, 2021). The Clerk's Office, though, rejected the Plaintiff's check and entered a "Clerks Notice of Filing Deficiency" claiming (erroneously) that the Plaintiff overpaid the Court's fees. See Clerk's Notice of Filing Deficiency [ECF No. 3] ("Enclosed you will find [check] no. 7373 in the amount of $400.00. The filing fee for 42 USC 1983 pro se [cases] is $350.00."). The Plaintiff did not overpay--he underpaid. And, thus, the Clerk's Office is INSTRUCTED to strike its Notice of Filing Deficiency [ECF No. 3]. The Clerk's Office is further INSTRUCTED to enter an Amended Notice of Filing Deficiency reflecting the correct filing fee of $402 and to mail it to the appropriate prison officials.
