The Undersigned has reviewed Plaintiff's motion and Defendant's response [ECF Nos. 83, 94] and is troubled by the contrary representations made about Plaintiff's compliance (or lack of compliance) with Local Rule 7.1's pre-filing conferral requirements.In its motion to strike affirmative defenses [ECF No. 83], Plaintiff unequivocally represents (p. 5) that its counsel did in fact confer with defense counsel but they could not reach an agreement about the issues raised in the motion. But Defendant's Response [ECF No. 94] represents (pp. 3 and 12-14] that Plaintiff's counsel failed to confer. In fact, according to Defendant, Plaintiff's counsel merely announced his plan to file such a motion and never discussed the merits of the parties' positions before filing the motion.Obviously, both sides cannot be correct. The representations are inconsistent and, indeed, contrary. Because Defendant Liberty Surplus Insurance Corp. included in its response a lengthy argument urging the Court to deny the motion to strike on the failure-to-confer ground alone and Plaintiff never filed a reply to address this factual anomoly, the Undersigned must determine which of the competing factual scenarios is accurate (or perhaps whether a third, not-yet-articulated version is accurate.).To help facilitate that goal, counsel for each side shall by November 15, 2022 file a detailed affidavit or declaration about the conferral (or non-conferral), supported by documents, if they exist, such as emails, text messages, etc. If the affidavits/declarations do not sufficiently resolve the confusion generated by the diametrically opposed representations, then the Undersigned may need to hold an evidentiary hearing, with the lawyers testifying in Court and subjecting themselves to cross-examination.
