Date Filed Document Text
January 25, 2022 Filing 14 First MOTION to Dismiss #1 Complaint and Incorporated Memorandum of Law by Gerald Alexander. Responses due by 2/8/2022 (Glasser, Gregory)
January 11, 2022 Opinion or Order Filing 13 PAPERLESS ORDER. Defendant has filed an Unopposed Motion for Extension of Time seeking an additional thirty (30) days to file his response to the Amended Complaint. (ECF No. 12). Defendant's response is due today, and defense counsel states that additional time is needed because he was retained "within less than 24 hours before [the response deadline]." Section II(B) of the Court's Practices and Procedures requires that all motions for extensions of time, absent an emergency, be filed no later than 48 hours prior to the deadline at issue, and permits the imposition of sanctions for non-emergent requests that fail to comply with this requirement. Having carefully reviewed the record and the Motion, the Court concludes that Defendant has shown good cause for a twenty-day extension of time. Accordingly, the Court hereby ORDERS that the Motion, (ECF No. 12), is GRANTED IN PART. Defendant shall file his response to the Amended Complaint no later than January 25, 2022. The parties are cautioned that going forward, all motions must comply with the Federal Rules of Civil Procedure, the Local Rules and the Court's Practices and Procedures. Signed by Magistrate Judge Chris M. McAliley on 1/11/2022. (nsy)
