January 24, 2022 Filing 13 NOTICE of Compliance with Patent Pretrial Order by ReFUUL, LLC re #9 Pretrial Order (Johnson, Mark)
January 13, 2022 Opinion or Order Filing 12 PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff ReFUUL, LLC's ("Plaintiff") Motion for Extension of Time. #11 . Therein, Plaintiff requests an extension of time to serve its Disclosure of Asserted Claims and Infringement Conditions (the "Disclosure") on all Parties as required by this Court's #9 Patent Pretrial Order. Id. at 1. Pursuant to this Court's Patent Pretrial Order, the deadline for Plaintiff to serve the Disclosure is January 25, 2022. See #9 . Plaintiff informs the Court that it intends to request that Defendants waive service of process pursuant to Federal Rule of Civil Procedure 4(d), however Plaintiff does not know at this time whether Defendants will be able to complete the waiver by the deadline to serve the Disclosure, or if Defendants will be unwilling to waive service of process. #11 at 2. Accordingly, Plaintiff requests leave to serve the Disclosure on all Parties within fourteen (14) days from the date the first named defendant makes an appearance in this case. Id. "District courts have 'unquestionable' authority to control their own dockets." Smith v. Psychiatric Sol., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (citation omitted). "This authority includes 'broad discretion in deciding how best to manage the cases before them.'" Id. (citation omitted). Here, the Court finds that Plaintiff's Motion is premature at this time. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that Plaintiff ReFUUL, LLC's Motion for Extension of Time #11 is DENIED. Plaintiff may renew the Motion at a later date. Signed by Judge K. Michael Moore on 1/13/2022. (elm)
